Terms of Service

You must be at least 18 years old and capable of forming a binding contract to use OmniPromote. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access.

You may use OmniPromote only for lawful marketing and outreach purposes. You must not use the Service to:

Send unsolicited bulk email (spam) to contacts who have not opted in; violate CAN-SPAM, GDPR, CASL, or other applicable anti-spam or data protection laws; harvest or scrape contact data from websites without permission; transmit malware, phishing content, or fraudulent messages; impersonate any person or entity; exceed dispatch limits through automation or API abuse; or resell access to the Service without written permission.

Violation of these rules may result in immediate account suspension without refund.

You retain ownership of all content you create using OmniPromote (campaign copy, uploaded contacts, generated articles). You grant us a limited license to store, process, and transmit your content solely to provide the Service.

You are solely responsible for the accuracy, legality, and appropriateness of your content and contact lists. We do not review outbound messages before you approve and send them.

You are the sender of record for all messages dispatched through OmniPromote. You are responsible for complying with all applicable laws governing electronic communications, including but not limited to CAN-SPAM (US), CASL (Canada), and GDPR (EU/UK).

OmniPromote provides suppression list management and unsubscribe handling tools. You must use them. Failure to honor unsubscribes is a violation of these Terms and may be illegal.

Paid plans are billed monthly in advance via Razorpay, accepting UPI, debit/credit cards, net banking, and wallets. Prices are listed in Indian Rupees (INR) as stated on the pricing page at the time of subscription.

You may upgrade or downgrade at any time. Upgrades take effect at the next billing cycle; downgrades take effect at the next billing cycle. New subscribers are eligible for a 7-day refund on their first payment. After that, subscription fees are non-refundable for the current period. We may change pricing with 30 days' notice to registered users. Continued use after a price change constitutes acceptance.

If your monthly dispatch count exceeds your plan limit, additional dispatches are charged at ₹1.50 per dispatch and billed at the end of the billing period. We will notify you when you reach 80% of your limit.

We will not automatically block active campaigns when you exceed your limit, but you may be asked to upgrade.

We aim for 99.5% monthly uptime excluding scheduled maintenance. We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time.

We may temporarily suspend access for maintenance, security updates, or abuse remediation. We will provide reasonable notice where possible.

OmniPromote, including its software, design, trademarks, and documentation, is owned by TechVent Labs and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited right to use the Service.

AI-generated content produced by the Service using your inputs is owned by you, subject to the terms of the underlying AI model providers.

To the maximum extent permitted by law, TechVent Labs is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of OmniPromote, including lost profits, lost data, or reputational harm.

Our total liability to you for any claim arising from these Terms or your use of the Service is limited to the amount you paid us in the 3 months preceding the claim.

You agree to indemnify and hold harmless TechVent Labs and its employees, contractors, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, your contact lists, or your violation of these Terms.

Either party may terminate the agreement at any time. We may terminate or suspend your account immediately, without notice, for material breach of these Terms, non-payment, or if required by law.

Upon termination, your right to use the Service ceases. We will retain your data for 30 days after account closure to allow export, then delete it.

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of a mutually agreed arbitral institution. You waive any right to a jury trial.

We may modify these Terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after changes take effect constitutes acceptance. If you do not agree, you should cancel your account before the effective date.
